Who can dispute a will?

  • Wife or husband
  • Defacto or same-sex partner
  • A former spouse or de facto partner
  • Child, stepchild or grandchild
  • Parent of a child of the deceased
  • Parent, brother or sister
  • Someone who was financially dependent on the deceased
  • Carer of the deceased

When Can You Enter into A Binding Financial Agreement?

  • Before the marriage or the commencement of a de facto relationship
  • During the marriage or de facto relationship
  • After the breakdown of the marriage or de fact relationship – If made after marriage, the binding financial agreement must be made within twelve (12) months of an order of divorce.

Contesting A Will & Challenging Validity?

If you have been left out of a Will or have been unfairly treated in terms of the amount of your inheritance, you may be able to claim against the estate.
Is there a time limit?
You have 12 months from the date of your loved one to make a claim. In some circumstances, this time limit may be extended.
